WHAT TO DO IF YOU ARE INVOLVED IN AN AUTOMOBILE ACCIDENT

If you are involved in an automobile accident, you should:

  1. Immediately Stop & Notify Your Local Police. Section 600 of the New York State Vehicle and Traffic Law requires any driver involved in an automobile accident, which involves personal injury or property damage, to immediately stop and contact the police. You should not move the cars, unless the position of the cars could cause some danger for another accident.
  2. Get Help. If any person is injured, you must immediately call for an ambulance. Dialing 911 will get you both the police and an ambulance. You should not attempt to treat the injured person yourself unless you have training in first aid. You should not try and move an injured person unless they are in a life threatening situation. You may make the injury worse by moving the person.
  3. Exchange Insurance Information. New York law requires every driver to exchange their name and address and the name and identification number of their insurance company with the other driver. Ask to see the other driver's license, registration and insurance card. Copy down all information on the license including the driver's identification number on his license. When the police arrive find out the name, badge number and precinct of the police officer. You or your representative can get a copy of the police report at the Police Station. The accident report is generally available within three business days.
  4. Get Names and Addresses of Any Witnesses. If there were any witnesses to the accident, you should attempt to obtain the name, address and phone number of the witnesses.
  5. Medical Treatment. Immediately get treatment for your injuries at the hospital or at your personal physician's office. Tell the examining doctor every complaint and injury you have, no matter how minor you may think it is. You may have a serious physical injury, which may take some time to develop. Often a person feels fine after an accident, but their injuries gradually develop over time.
  6. Notify Your Insurance Company. Whenever you are in an accident involving an injury or property damage, you must notify your insurance company. If you fail to notify your insurance company within a reasonable time after the accident, your Insurance Company could have the right to refuse to cover the claim.
